Abstract

Pembimbing : Teti Hadiati M.H.I Perlindungan Konsumen dalam Undang-Undang Nomor 8 Tahun 1999, Pengertian perlindungan konsumen menurut pasal 1 ayat 1 UUPK atau Undang-Undang Nomor 8 Tahun 1999 yaitu jaminan kepastijan hukum yang diperoleh dengan segala upaya dalam memberikan perlindungan terhadap konsumen. Ringkasan mengenai perlindungan konsumen dibuat dengan tidak terlalu sulit dimengerti dengan struktur kalimat yang sederhana serta melibatkan berbagai aspek perlindungan konsumen. Maksud dari kalimat “kepastian hukum” tujuannya dapat dijadikan sebagai benteng untuk mencegah tindakan sewenang-wenang dari para pelaku usaha yang dapat merugikan konsumen. Didalam UU perlindungan konsumen mengatur mengenai hak konsumen, kewajiban pelsaku usaha beserta perbuataan yang dilarang dan tanggungjawab sebagai pelaku usaha. Penelitian ini merupakan penelitian hukum empiris dengan mengunakan pendekata Kualitatif. Adapun sumer data berupa data primer dan sekunder dengan teknik pengumpulan data, melalui observasi, wawancara, dokumentasi, dan penyajian data. Metode yang penulis gunakan dalam penelitian ini yaitu metode deskriptif anaalisis. Hasil penelitian ini menujukan bahwa praktik Cod Cek Dulu di Kecamatan Limbangan Kulon , tidak sesuai dengan SOP yang sebagaimana terdapat pada peraturan Shopee. Dalam hal tersebut kurir tidak melaksanakan kewajibannya sesuai SOP pada program COD Cek Dulu. Dimana transaksi yang dilakukannya sama seperti transaksi COD seperti biasa tanpa ada proses pengecekan barang oleh konsumen. Apabila ditinjau dari segi UUPK, kurir sebagai mitra dari Shopee telah melanggar hak konsumen sesuai dengan pasal 4 UUPK dan tidak melaksanakan kewajibannya sebagai pelaku usaha yaitu pada Pasal 7 dan Pasal 8 huruf (f). Namun pihak Shopee menyediakan fitur “Chat dengan CS”sebagai bentuk upaya perlindungan konsumen. praktik COD Cek Dulu yang tidak lengkap menyebabkan tidak terpenuhinya konsumen tidak diberi kesempatan untuk memeriksa barang yang ditransaksikan sebelum membayar, yang dapat berakibat apabila terdapat suatu cacat produk akan menimbulkan ketidakrelaan pada pihak konsumen. Pembimbing : Teti Hadiati M.H.I Consumer Protection in Law Number 8 of 1999, The definition of consumer protection according to article 1 paragraph 1 of the UUPK or Law Number 8 of 1999 is a guarantee of legal certainty obtained by all efforts in providing protection to consumers. A summary of consumer protection is made so that it is not too difficult to understand with a simple sentence structure and involves various aspects of consumer protection. The meaning of the sentence "legal certainty" is that it can be used as a fortress to prevent arbitrary actions from business actors that can harm consumers. The Consumer Protection Law regulates consumer rights, business actor obligations along with prohibited actions and responsibilities as business actors. This research is an empirical legal research using a Qualitative approach. The data sources are in the form of primary and secondary data with data collection techniques, through observation, interviews, documentation, and data presentation. The method used by the author in this study is the descriptive analysis method. The results of this study indicate that the practice of Cod Check First in Limbangan Kulon District is not in accordance with the SOP as stated in the Shopee regulations. In this case, the courier did not carry out his obligations according to the SOP in the COD Cek Dulu program. Where the transaction carried out was the same as a regular COD transaction without any goods checking process by the consumer. When viewed from the perspective of UUPK, the courier as a partner of Shopee has violated consumer rights in accordance with Article 4 of UUPK and has not carried out his obligations as a business actor, namely in Article 7 and Article 8 letter (f). However, Shopee provides a "Chat with CS" feature as a form of consumer protection. The incomplete COD Cek Dulu practice results in consumers not being given the opportunity to check the goods being transacted before paying, which can result in the consumer being unwilling if there is a product defect.
