Abstract

Penelitian ini dilatarbelakangi oleh fenomena tidak terpenuhinya hak nafkah perempuan pasca cerai gugat di Kelurahan Pasirkratonkramat, Kecamatan Pekalongan Barat, Kota Pekalongan. Meskipun landasan hukum perlindungan nafkah telah tersedia, perempuan yang mengajukan cerai gugat pada kenyataannya tidak memperoleh nafkah iddah maupun mut’ah setelah perceraian terjadi. Penelitian ini bertujuan untuk menganalisis bagaimana pemenuhan hak nafkah perempuan pasca cerai gugat di Kelurahan Pasirkratonkramat dan bagaimana implikasinya terhadap keadilan sosial ditinjau dari perspektif maqasid syariah Jasser Auda. Penelitian menggunakan metode sosiologis-yuridis dengan pendekatan empiris. Data diperoleh melalui wawancara mendalam terhadap perempuan yang mengalami cerai gugat. Hasil penelitian menunjukkan bahwa seluruh informan tidak memperoleh nafkah iddah maupun mut’ah pasca perceraian. Hal ini disebabkan oleh minimnya pengetahuan hukum informan, ketidakhadiran suami dalam persidangan sehingga putusan dijatuhkan secara verstek, serta tidak adanya pendampingan hukum. Kewenangan ex officio hakim sebagaimana diamanatkan SEMA No. 3 Tahun 2018 belum diterapkan secara optimal. Kondisi ini menimbulkan implikasi serius terhadap keadilan sosial: beban ekonomi pasca perceraian sepenuhnya ditanggung perempuan dan keluarga besarnya, serta perempuan menghadapi tantangan ganda sebagai pengasuh anak sekaligus pencari nafkah. Ditinjau dari perspektif maqasid syariah Jasser Auda, sistem hukum yang ada belum mampu mewujudkan nilai keadilan, perlindungan kemaslahatan, dan penghormatan terhadap martabat perempuan sebagaimana dikehendaki tujuan-tujuan syariat. This research is motivated by the phenomenon of unfulfilled women's right to financial support following khul' divorce in Pasirkratonkramat Village, West Pekalongan District, Pekalongan City. Despite the availability of legal protections, women who file for khul' divorce in practice receive neither iddah nor mut'ah maintenance after the divorce takes place. This study aims to analyze how women's right to financial support is fulfilled following khul' divorce in Pasirkratonkramat Village and what implications this has for social justice from the perspective of Jasser Auda's maqasid syariah. The study employs a juridical-sociological method with an empirical approach. Data were collected through in-depth interviews with four female informants who had experienced khul' divorce. The findings reveal that none of the informants received iddah or mut'ah maintenance following their divorce. This was caused by three main factors: the informants' limited knowledge of their legal rights in khul' divorce cases, the absence of husbands during court proceedings resulting in verstek decisions, and the lack of legal assistance throughout the process. The judge's ex officio authority as mandated by SEMA No. 3 of 2018 was not optimally exercised. This situation has serious implications for social justice: the economic burden after divorce falls entirely on the women and their extended families, and women face a dual burden as both caregivers and breadwinners. From the perspective of Jasser Auda's maqasid syariah, the existing legal system has yet to realize the values of justice, protection of welfare, and respect for women's dignity as demanded by the objectives of Islamic law.
