Ahmad Yusron (1218121): “The Practice of Motorcycle Pawning Among the Muslim Community in Talun District Pekalongan Regency” Undergraduate thesis Sharia Economic Law Program Faculty of Sharia UIN K.H. Abdurrahman Wahid 2025. Supervisor: Noorma Fitriana M. Zain, M.Pd. Pawn (rahn) is a form of agreement in which the pledgor submits an item as collateral to the pledgee in order to obtain money. In Talun District, Pekalongan Regency, the practice of motorcycle pawning is quite common. In practice, after the item is pawned to the pledgee, the pledgee often uses the pledged item. A motorcycle that is used excessively or continuously by the pledgee is at higher risk of damage, and the responsibility for the damage is often still imposed on the pledgor. This study aims to examine the responsibility for damage to pawned items and to analyze whether the practice of motorcycle pawning in Talun District, Pekalongan Regency, is in accordance with Islamic law. This research is a field study (field research) using a qualitative approach with an empirical type of research. The data were obtained through observation, interviews, and documentation. The results of the study indicate that in practice, when the collateral item is used for daily activities by the pledgee, the risk of damage increases. However, the responsibility for the damage is still borne by the pledgor. Regarding the utilization of pawned items, the majority of scholars (jumhur ulama) state that the pledgee is not allowed to use the pledged item, although Hanbali scholars permit it if there is permission from the pledgor. The majority also assert that if the used item is damaged, the party who used it is responsible for compensating the loss.
