Abstract

This research aims to explain the legal provisions in Pekalongan City Regional Regulation Number 7 of 2020 concerning Waste Management, as well as to find out the legal consequences if these provisions are not implemented optimally. This research method is empirical juridical using a sociological approach. Pekalongan City as a densely populated area faces serious problems related to waste management, characterized by the high volume of daily waste, declining environmental quality, and lack of community involvement. This study uses a non-doctrinal method with a qualitative approach, based on field observations and interview data. Regional Regulation No. 7 of 2020 has substantially included the 3R (Reduce, Reuse, Recycle) principles, the obligations of business actors and the community, as well as institutional strengthening and public participation. In terms of law enforcement, this regional regulation has also been equipped with administrative sanctions such as government coercion, fines, and revocation of permits. However, in its implementation, many obstacles are still found, including the accumulation of waste at the Degayu Landfill, weak supervision, and the absence of routine management that negatively impacts the environment and community comfort. The legal consequences of violations of this regional regulation include the loss of legal certainty, the emergence of injustice in budget governance, and the decline in the usefulness of the law which has an impact on environmental damage and potential social conflicts. Therefore, successful waste management requires long-term commitment from local governments, active community participation, and sustainable policy evaluation so that effective waste management goals can be achieved.
