Abstract

Penelitian ini dilatar belakangi belum optimalnya implementasi peraturan Menteri keuangan republik Indonesia nomor 122 tahun 2023 dalam pelaksanaan program Lelang digital pada produk UMKM di Kota Tegal. Kebijakan ini merupakan Upaya pemerintah dalam mewujudkan transparansi, efisiensi, dan perluasan akses pasar bagi UMKM melalui pemanfaatan teknologi digital. Namun dalam pelaksanaannya partisipasi UMKM masih rendah, sehingga menunjukkan adanya kesenjangan antara pengaturan normatif dengan kondisi empiris di lapangan. Penelitian ini bertujuan untuk mengetahui Implementasi Peraturan Menteri Keuangan Republik Indonesia Nomor 122 tahun 2023 Dalam Pelaksanaan Program Lelang Digital pada produk UMKM di Kota Tegal dan bagaimana pengaturan manajemen Risiko dalam pelaksanaan program tersebut. Penelitian ini menggunakan metode penelitian kualitatif dengan pendekatan deskriptif. Data penelitian di peroleh dari informan yang berasal dari Kantor Pelayanan Kekayaan Negara dan Lelang (KPKNL) Tegal serta Dinas Koperasi, Usaha Kecil, dan Menengah Kota Tegal. Pengumpulan data dilakukan melalui wawancara dan dokumentasi. Selanjutnya, data yang diperoleh direduksi, disajikan, dan ditarik kesimpulan untuk kemudian dianalisis menggunakan teori implementasi kebijakan, teori efektivitas hukum, teori manajemen risiko dan Teori Maqasid Syari’ah guna mengkaji pelaksanaan program lelang digital pada produk UMKM di Kota Tegal. Hasil penelitian menunjukkan bahwa implementasi peraturan Menteri keuangan republik Indonesia nomor 122 tahun 2023 secara normatif telah di laksanakan sesuai dengan ketentuan melalui penyediaan sistem Lelang elektronik dan pelaksanaan tahapan secara daring. Namun, secara substantif implementasi tersebut belum berjalan optimal karena komunikasi kebijakan belum merata, rendahnya pemahaman teknis, serta persepsi pelaku UMKM terhadap kompleksitas prosedur Lelang Digital. Ditinjau dari teori efektivitas hukum, faktor Masyarakat dan budaya hukum menjadi hambatan dominan. Selain itu pengaturan manajemen Risiko belum diterapkan secara komprehensif, khususnya pada tahap mitigasi dan evaluasi. Dengan demikian diperlukan penguatan implementasi melalui sosialisasi yang lebih terarah, penyederhanaan prosedur, dan penerapan manajemen Risiko yang terintegrasi agar tujuan kebijakan dapat tercapai secara efektif. This research was motivated by the suboptimal implementation of the Regulation of the Minister of Finance of the Republic of Indonesia Number 122 of 2023 in the implementation of the digital auction program for MSME products in Tegal City. This policy represents the government's effort to promote transparency, efficiency, and broader market access for Micro, Small, and Medium Enterprises (MSMEs) through the utilization of digital technology. However, in practice, MSME participation remains low, indicating a gap between the normative provisions and the empirical conditions in the field. This study aims to analyze the implementation of the Regulation of the Minister of Finance of the Republic of Indonesia Number 122 of 2023 in the implementation of the digital auction program for MSME products in Tegal City and to examine the application of risk management in the implementation of the program. This study employed a qualitative research method with a descriptive approach. The research data were obtained from informants at the State Assets and Auction Service Office (KPKNL) of Tegal and the Office of Cooperatives, Small and Medium Enterprises, and Trade of Tegal City. Data were collected through interviews and documentation. The collected data were then reduced, presented, and verified to draw conclusions before being analyzed using policy implementation theory, the theory of legal effectiveness, risk management theory, and Maqasid Sharia theory to examine the implementation of the digital auction program for MSME products in Tegal City. The findings indicate that the implementation of the Regulation of the Minister of Finance of the Republic of Indonesia Number 122 of 2023 has, from a normative perspective, been carried out in accordance with the applicable provisions through the provision of an electronic auction system and the implementation of online auction procedures. However, substantively, the implementation has not yet been optimal due to uneven policy dissemination, limited technological understanding, and MSME participants' perceptions regarding the complexity of digital auction procedures. Based on the theory of legal effectiveness, the social and legal culture factors constitute the main obstacles. Furthermore, risk management has not been implemented comprehensively, particularly in the stages of risk mitigation and evaluation. Therefore, strengthening implementation through more targeted socialization, simplifying procedures, and applying integrated risk management is necessary to ensure that the policy objectives can be achieved effectively.
