Abstract

Penelitian ini bertujuan untuk menganalisis perilaku hukum pelaku usaha industri rumah tangga produk makanan kemasan terhadap kewajiban pencantuman sertifikasi halal di Kecamatan Bojong Kabupaten Pekalongan serta menganalisis faktor-faktor yang memengaruhi perilaku hukum tersebut berdasarkan Theory of The Behavior of Law Donald Black. Penelitian ini merupakan penelitian hukum empiris dengan pendekatan deskriptif kualitatif dan pendekatan sosiologis. Data diperoleh melalui observasi, wawancara, dan dokumentasi terhadap sepuluh pelaku usaha industri rumah tangga yang dipilih menggunakan teknik purposive sampling. Analisis data dilakukan menggunakan model Miles dan Huberman melalui tahapan reduksi data, penyajian data, dan penarikan kesimpulan. Selanjutnya, data dianalisis menggunakan Theory of The Behavior of Law Donald Black untuk menjelaskan hubungan antara perilaku hukum pelaku usaha dengan kondisi sosial yang melingkupinya. Hasil penelitian menunjukkan bahwa perilaku hukum pelaku usaha industri rumah tangga terhadap kewajiban sertifikasi halal masih belum mencerminkan kepatuhan terhadap ketentuan Undang-Undang Nomor 33 Tahun 2014 tentang Jaminan Produk Halal. Seluruh responden belum memiliki sertifikat halal meskipun telah mengetahui adanya kewajiban tersebut. Berdasarkan analisis Theory of The Behavior of Law Donald Black, perilaku hukum tersebut dipengaruhi oleh berbagai faktor sosial, antara lain terbatasnya sosialisasi mengenai sertifikasi halal, kurangnya pemahaman terhadap prosedur pengurusan sertifikat halal, anggapan bahwa proses sertifikasi memerlukan biaya dan waktu yang relatif lama, lemahnya pengawasan dan penegakan hukum, serta budaya masyarakat yang menganggap produk yang diproduksi oleh pelaku usaha Muslim telah halal meskipun belum memiliki sertifikat halal. Penelitian ini menyimpulkan bahwa perilaku hukum pelaku usaha industri rumah tangga produk makanan kemasan di Kecamatan Bojong masih menunjukkan tingkat kepatuhan yang rendah terhadap kewajiban sertifikasi halal. Berdasarkan Theory of The Behavior of Law Donald Black, kondisi tersebut tidak hanya dipengaruhi oleh aspek normatif, tetapi juga oleh struktur sosial, budaya, organisasi, dan kontrol sosial yang berkembang dalam masyarakat. Oleh karena itu, diperlukan peningkatan sosialisasi, pendampingan sertifikasi halal, optimalisasi Program Sertifikasi Halal Gratis (SEHATI), serta penguatan pengawasan dan penegakan hukum agar kepatuhan pelaku usaha terhadap kewajiban sertifikasi halal dapat meningkat. ABSTRACT This study aims to analyze the legal behavior of home-based packaged food business owners toward the obligation to obtain halal certification in Bojong District, Pekalongan Regency, and to examine the factors influencing such legal behavior based on Donald Black’s Theory of the Behavior of Law. This research employed an empirical legal research method using a descriptive qualitative and sociological approach. The data were collected through observation, interviews, and documentation involving ten home-based business owners selected using a purposive sampling technique. The data were analyzed using the Miles and Huberman interactive model, consisting of data reduction, data display, and conclusion drawing. Furthermore, the findings were interpreted using Donald Black’s Theory of the Behavior of Law to explain the relationship between the legal behavior of business owners and the social conditions surrounding them. The findings indicate that the legal behavior of home-based business owners regarding the obligation to obtain halal certification has not yet reflected compliance with the provisions of Law Number 33 of 2014 on Halal Product Assurance. None of the respondents had obtained halal certification, although they were aware of the legal obligation. Based on Donald Black’s Theory of the Behavior of Law, such legal behavior is influenced by various social factors, including limited dissemination of information regarding halal certification, insufficient understanding of the halal certification procedure, the perception that the certification process requires considerable time and financial resources, weak supervision and law enforcement, and the prevailing belief that products manufactured by Muslim business owners are inherently halal despite lacking official halal certification. This study concludes that the legal behavior of home-based packaged food business owners in Bojong District demonstrates a low level of compliance with the obligation to obtain halal certification. According to Donald Black’s Theory of the Behavior of Law, this condition is influenced not only by normative legal aspects but also by social structure, culture, organization, and social control within the community. Therefore, greater efforts are required through continuous socialization, assistance in the halal certification process, optimization of the Free Halal Certification Program (SEHATI), as well as strengthened supervision and law enforcement to improve business owners' compliance with the obligation to obtain halal certification.
