Abstract

Pariwisata ramah Muslim merupakan konsep pengembangan pariwisata yang memperhatikan kebutuhan wisatawan Muslim dan kenyamanan seluruh pengunjung. Pemerintah Provinsi Jawa Tengah menetapkan Peraturan Gubernur Jawa Tengah Nomor 40 Tahun 2023 tentang Pariwisata Ramah Muslim dalam Rangka Pengembangan Ekonomi. Pergub ini mengatur kriteria daya tarik dan kawasan wisata ramah Muslim, termasuk fasilitas ibadah, tempat wudu, toilet bersih, makanan halal, dan pembayaran melalui perbankan syariah. Namun, di Waduk Cacaban Kabupaten Tegal, area wudu perempuan masih terlalu sempit, perlengkapan ibadah belum memadai, ketersediaan air bersih terbatas, dan sosialisasi kepada pelaku usaha belum merata. Penelitian ini bertujuan untuk menganalisis implementasi kebijakan, mengidentifikasi kendala, dan meninjaunya berdasarkan maqashid syariah. Penelitian ini diharapkan menjadi bahan evaluasi bagi pemerintah daerah dan pengelola wisata. Penelitian ini menggunakan metode kualitatif deskriptif dengan pendekatan yuridis empiris. Data primer diperoleh melalui observasi dan wawancara dengan pemerintah daerah, pengelola wisata, pelaku usaha, serta wisatawan. Data sekunder dikumpulkan melalui studi dokumentasi dan kepustakaan yang meliputi peraturan perundang-undangan, buku, jurnal ilmiah, dan dokumen terkait. Data dianalisis melalui reduksi data, penyajian data, dan penarikan kesimpulan berdasarkan ketentuan hukum serta perspektif maqashid syariah. Hasil penelitian menunjukkan bahwa implementasi kebijakan telah berjalan, tetapi belum optimal. Fasilitas yang tersedia meliputi musala, tempat wudu, dukungan Zona KHAS (Kuliner Halal, Aman, dan Sehat), pembayaran melalui perbankan syariah, sertifikasi halal pedagang, serta transparansi harga. Kendala meliputi keterbatasan air bersih, fasilitas ibadah yang belum memadai, sosialisasi yang belum merata, dan belum adanya anggaran khusus. Kondisi tersebut menunjukkan perlunya peningkatan pelaksanaan kebijakan agar kriteria pariwisata ramah Muslim terpenuhi lebih baik. Dalam perspektif maqashid syariah, implementasi ini terutama berkaitan dengan tingkat al-hajiyyah, karena fasilitas dan pelayanan bertujuan memberikan kemudahan serta mengurangi kesulitan wisatawan. Muslim-friendly tourism is a tourism development concept that addresses the needs of Muslim travelers while ensuring the comfort of all visitors. The Central Java Provincial Government has enacted Governor Regulation Number 40 of 2023 concerning Muslim-friendly Tourism for Economic Development. This regulation establishes criteria for Muslim-friendly tourist attractions and areas, covering requirements such as prayer facilities, ablution areas, clean restrooms, halal food, and payment options through Sharia compliant banking. However, at the Cacaban Reservoir in Tegal Regency, the women’s ablution area remains too cramped, prayer equipment is inadequate, the supply of clean water is limited, and the dissemination of information to business operators has been uneven. This study aims to analyze the implementation of the policy, identify existing obstacles, and evaluate the situation through the lens of maqashid syariah (the objectives of Islamic law). It is intended to serve as a basis for evaluation for both local government authorities and tourism management. This study employs a descriptive qualitative method with a juridical-empirical approach. Primary data were gathered through observations and interviews with local government officials, tourism managers, business operators, and tourists. Secondary data were collected via documentation and literature reviews, including relevant legislation, books, academic journals, and other pertinent documents. Data analysis involved data reduction, data presentation, and the drawing of conclusions based on legal provisions and the perspective of maqashid syariah. The findings indicate that while the policy is being implemented, it has yet to reach an optimal level. Existing facilities include prayer rooms (musala), ablution areas, support for the "KHAS" zone (Halal, Safe, and Healthy Culinary), Sharia-compliant payment options, halal certification for vendors, and price transparency. Challenges include a limited supply of clean water, insufficient prayer facilities, inconsistent dissemination of information, and the absence of a dedicated budget. These conditions highlight the need to improve policy implementation to better meet the criteria for Muslim-friendly tourism. From the perspective of maqashid syariah (the objectives of Islamic law), this implementation primarily relates to the level of al-hajiyyah (needs/conveniences), as the facilities and services are intended to provide ease and alleviate difficulties for tourists.
